Terms of Service

1. Who this agreement is between
This agreement is between InsightNotes ("InsightNotes," "we," "us") and the practice or clinician who creates an InsightNotes account ("you," "your practice"). By creating an account, subscribing, or using InsightNotes, you agree to these terms.
2. What InsightNotes is
InsightNotes is desktop software that helps a clinician write psychological evaluation reports. Your client records are stored, encrypted, on your own computers — not on our servers. When you use AI drafting, the specific text you're writing is sent to our AI gateway to help draft that section, and nothing else about your practice or your clients leaves your computers as part of that.
3. Your account and subscription
Your plan sets how many computers your practice can connect and how much AI drafting is included each month. Your records stay on your own computers, and you can always open, read, and edit them, whatever the state of your account.
If your free trial ends without a subscription, or your subscription ends, new AI drafting, starting new clients and evaluations, and exporting reports (as Word or PDF files) pause until you subscribe. You can cancel any time; your subscription stays active through the period you already paid for.
If a payment fails, everything keeps working while you update your payment method. If it is still unpaid 7 days after it first failed, exporting reports pauses until it is paid.
We may publish a new version of an agreement your practice must accept, such as this one or the Business Associate Agreement. We will normally give at least 14 days' notice before it takes effect. If no administrator of your practice has accepted it by then, starting new clients and evaluations, AI drafting, and exporting reports pause until one does.
4. Acceptable use
Use InsightNotes only for legitimate clinical documentation work, keep your credentials to yourself, and comply with the laws and professional obligations that apply to you.
5. What we don't guarantee
InsightNotes is provided "as is." AI-drafted text is a starting point for a clinician to review, edit, and take responsibility for — never a substitute for clinical judgment.
6. Limitation of liability
To the extent allowed by law, InsightNotes' total liability is limited to the amount you paid in the twelve months before the claim arose.
7. Governing law
This agreement is governed by the laws of the State of Georgia. Any dispute will be brought exclusively in the state or federal courts located in Georgia.
